Our general conditions of sale

These conditions govern sales on the Jean Martin website, www.jeanmartin.fr. These conditions apply to the exclusion of all other conditions, in particular those in force for in-store sales.

ARTICLE 1- CONDITION FOR PLACING AN ORDER

You declare that you are at least 18 years old and have the legal capacity or hold parental authorization allowing you to place an order on our website.

ARTICLE 2 - THE OFFER

Period of validity: The offers on the site are valid while they are online.
Territorial scope: The offers are valid for any purchase made online, and for delivery in Metropolitan France.

ARTICLE 3 - VALIDATION

When you click on the "Confirm your order" button after the order process, you declare that you accept this as well as all of these "General Conditions of Sale" fully and without reservation.
The data recorded by www.jeanmartin.fr constitutes proof of all transactions carried out by www.jeanmartin.fr and its customers.
The data recorded by the payment system constitutes proof of financial transactions.

ARTICLE 4 – PRICE AND AVAILABILITY


4-1 PRICE

The prices displayed on the Site are indicated in euros, all French taxes included (French VAT and other applicable taxes) excluding shipping costs.

4-2 AVAILABILITY

All products on the site are available and our offers are offered while stocks last.
If a product is unavailable after placing your order, we will inform you by email or telephone within 24 hours (working days).
You can then request the cancellation of your order or the exchange of the missing product(s). In the event of cancellation, your order will be refunded within 14 days maximum.


ARTICLE 5 - SATISFIED OR REFUNDED

You have a right of return of 14 working days from receipt of the package to return it to us, in its original packaging, and obtain a refund or exchange.
During this period, the package return guarantee is complete: no justification will be requested.
For any returned item that you have paid for, the following terms apply:
- the package was returned without having been opened: refund of the package.
- the product is returned because you are not satisfied: refund of the package, return costs at your expense.
- the product is returned for a reason that is the responsibility of Jean Martin: reimbursement of the product, shipping costs and possible returns.
In the case of a refund, the costs are reimbursed by check.

To process your requests, we kindly ask you to specify your first and last name, address, date and order number. We will not be able to take into account any incomplete request.

ARTICLE 6 - PARTICIPATION IN SHIPPING AND PROCESSING COSTS

Shipments to mainland France.
The contribution to shipping costs breaks down as follows:

- For an order whose amount including tax is between 0 and 85€ => 9€ including tax
- Free shipping for all orders over €85 including tax.

ARTICLE 7 - PROCESSING TIMES FOR YOUR ORDER AND ITS DELIVERY

Jean Martin strives to process its orders within 3 to 5 days from validation of the order. The company therefore undertakes to deliver its goods to mainland France within 8 working days (Monday to Friday inclusive) after validation of the order to the address indicated when placing your order.
Delivery times are indicated for information purposes only and cannot in any way constitute a commitment on the part of Jean Martin, which, for transport, uses the services of third party providers.
Delivery times are automatically suspended by any event beyond the control of Jean Martin and having the consequence of delaying delivery.
Furthermore, Jean Martin declines all responsibility and any compensation in the event of delay due to false or erroneous information that you may have indicated at the time of ordering.

Above 18 kg, the package cannot be delivered to a relay point but only to your home.


ARTICLE 8- SITE ACCESS LICENSE

We grant you a limited access license to the site for your personal use as long as it is for non-commercial purposes and on the condition that the User does not modify the information contained and that he keeps intact all copyrights and other notices of ownership. Modification of these documents or their use for another purpose constitutes an infringement of intellectual property rights.


ARTICLE 9- COMMENTS, CRITICISMS, COMMUNICATIONS AND OTHER CONTENT

Users may send us criticisms, comments, remarks as well as suggestions, questions or ideas as long as this content is not illegal, threatening, abusive, obscene, defamatory, slanderous, infringing intellectual property rights, or harmful to third parties and does not contain computer viruses, political activism, commercial solicitation, mass mailing, chain mailing or any other form of “spam”. You must under no circumstances use a false email address or impersonate a person or entity. We reserve the right, at our sole discretion, to moderate certain comments for technical reasons (insufficient storage capacity, viruses, clarity of the web page) or legal reasons (defamatory, misleading, racist or obscene comments). The reasons previously mentioned are examples and should not be interpreted as exhaustive.

ARTICLE 10 - SECURITY AND CONFIDENTIALITY

10-1 - SECURITY

Payment for products is made only by credit card or check. You must absolutely pay for your purchases in full when ordering. It is not possible to pay on delivery.
Our site is the subject of a security system. Entering your bank details is secure. The information you will enter (card number and expiration date) will be encrypted and will not circulate unencrypted on the Internet. All sensitive data linked to means of payment are thus protected.
For payments by check, the order will only be sent upon receipt of it.

Email addresses are intended for Jean Martin services only. No email address is sold, given, assigned or exchanged. They are only used for the smooth running of your order (sending an order confirmation email, tracking the status of the order, etc.) and, if you accept it, for sending promotional offers and e-mailing information about our brand.

ARTICLE 11 - APPLICABLE LAW - DISPUTES

This agreement is subject to French law. The language of this contract is French. In the event of a dispute, the Tarascon court will have sole jurisdiction.

ARTICLE 12 - COMPETENT JURISDICTION

The conditions of sale are governed by French law. All disputes likely to arise between the parties concerning, among other things, the validity, interpretation, execution or termination of the contract will be decided definitively by the Commercial Court of Tarascon.

We may collect personal data about you through our website www.jeanmartin.fr

The data we collect is, depending on the case:

• authorized personnel from the marketing department, the sales department, the departments responsible for handling customer relations and prospecting, the administrative services, the logistics and IT services as well as their line managers;
• authorized personnel from the services responsible for control (auditor, services responsible for internal control procedures, etc.);
• the authorized personnel of the subcontractors as long as the contract signed between the subcontractors and the JEAN MARTIN Group mentions the obligations incumbent on the subcontractors in terms of protecting the security and confidentiality of data and specifies in particular the security objectives that must be achieved.

The personal data collected is kept for the following periods:

• in the case of individual customers: 10 years after the end of the contractual relationship with the customer concerned;
• regarding prospects: 3 years from their collection or our last contact with you;
• regarding navigation data and use of the website: the IP address obtained by the Google Analytics cookie is kept for a period of 38 months from the deposit of the cookie.
