These conditions apply to sales on the Jean Martin website, www.jeanmartin.fr.  These conditions supersede any other conditions, including those that apply to our shop.

ARTICLE 1 – OFFER
Validity period: Offers on the site remain valid for as long as they are on line:
Geographical limits: Offers are available for any online purchases, and for delivery in Metropolitan France.


ARTICLE 2 – PLACING AN ORDER
In clicking ‘Confirm your order’ at the end of the ordering process, you declare that you agree to these Terms and Conditions of Sale in their entirety and without reservation.
Data recorded by www.jeanmartin.fr shall constitute evidence of all transactions carried out by and between by www.jeanmartin.fr and its customers.
Data recorded by the payment system shall constitute evidence of financial transactions.


ARTICLE 3 - AVAILABILITY
All products displayed on the site are available and our promotions are offered subject to availability.
If any product becomes unavailable after your order has been placed we will inform you by e-mail or telephone within 1 working day.
You may then cancel your order or exchange the product(s) that is/are out of stock.


ARTICLE 4 – SATISFACTION OR YOUR MONEY BACK
You are entitled to return the product to us within 7 working days from the day you receive your package, in its original packing, and receive a refund or an exchange.
During this period, the package may be returned without giving any reason.
For any article returned for which you have paid, the following conditions apply:
- if the package is returned unopened: goods will be refunded.
- if the product is returned because you are not satisfied with it: goods will be refunded, but you pay return costs.
- if the product is returned for a reason for which Jean Martin is responsible, the product and postage & packaging costs both ways will be refunded.
Refunds are made by cheque.

ARTICLE 5 – POSTAGE AND PACKAGING COSTS
Deliveries in Metropolitan France.
Delivery costs are as follows:
- Packages weighing between 0 and 2.5 kg => € 6 incl. VAT
- Packages weighing between 2,5 and 6 kg => € 8 incl. VAT
- Packages weighing between 6 and 10 kg => € 10 incl. VAT
- Packages weighing between 10 and 15 kg => € 12 incl. VAT
- Packages weighing between 15 and 20 kg => € 14 incl. VAT
- Packages weighing between 20 and 160 kg => € 16 incl. VAT

ARTICLE 6 – DISPATCH AND DELIVERY PERIODS
Your orders are dealt with as quickly as possible by the Jean Martin shop from Monday to Friday inclusive.
Goods are dispatched 48 hours after receipt of your order.
Delivery by ‘Colissimo’ or courier.

ARTICLE 7 – SECURITY AND CONFIDENTIALITY
A - SECURITY
Products may only be paid for by Credit or Debit Card.  You must pay for your purchases in full at the time of order.  Payment on delivery cannot be accepted.
Our website uses a security system.  Your bank details are secure.  Information that you type in (card no. and expiry date) are encrypted and are not on public view on the Internet.  All sensitive data connected with payment is protected in this way.

B – PERSONAL DATA PROTECTION
Jean Martin takes great care to protect your personal data and does everything in its power to protect your rights.

Your right to access and correct data:
In accordance with the French Information Technology and Freedoms Act of 6th January 1978, you have the right to access, correct or contest personal data we hold about you.

This contract is subject to French Law.  The language of this contract is French.  In the event of any dispute, the Commercial Court of Tarascon will have jurisdiction of competence.

ARTICLE 9 - JURISDICTION
These terms and sales are governed by French Law.  Any dispute which may arise between the parties concerning, inter alia, the validity, construction, fulfilment or termination of the contract will be settled finally by the Tarascon Commercial Tribunal.
